Argentine Justice suspends distributions of Glovo, Rappi

The Observer from Uruguay. The Argentine judge Andrés Gallardo, head of the Administrative and Tax Litigation Court No. 2, ordered this Friday to immediately suspend the activity of delivery application companies Rappi, AplicacionesYa and Glovo in the city of Buenos Aires, as reported by La Nación.

The judge also asked the Buenos Aires City Police to stop possible shipments from being made and ordered the credit card companies to block operations that request to use the service of these applications.

Gallardo also ordered the applications present in Argentina to hand over a list of their distributors to the justice system to have greater control over the deliveries that move around the city of Buenos Aries, where these applications are more common.

The measure occurs at a time when the applications were questioned in the capital of Argentina by the actions of the Glovo company after one of its distributors was run over while delivering pizza. So, the only concern of the company was the condition of the package, and at no time were they concerned about the health of the delivery.

The resolution by that court sought to prevent accidents from continuing to occur, prevent and avoid situations of food mishandling and avoid distortion of distribution systems.

As reported by La Nación, the Ministry of Transportation and Transit of the city of Buenos Aires will appeal the ruling because it violates freedom of work.

The precautionary measure aims to enforce what was already resolved on July 10 by an Appeals Chamber. From that first ruling, the applications had 10 days to regularize their activity or prohibit their distributors from circulating without a helmet and reflective clothing, as published on the page of the Judicial Power of the City of Buenos Aires.

The resolution by that court sought to prevent accidents from continuing to occur, to prevent and avoid situations of improper handling of food, and to avoid distortion of distribution systems so that they are not used to consume illicit goods.

As stipulated by law, drivers must have a helmet, reflective vest and the box where the fixed package is sent to the motorcycle or bicycle. Those dealers who drive a motorcycle and insurance coverage must also have a passbook. As reported by the Infobae portal, this equipment must be paid for by companies and not by workers.

"The aforementioned companies are expressly forbidden to compel employees to pay for the established provisions," the ruling held.

Gallardo said these same requirements were communicated to companies seven months ago but without effective compliance.
